DNA Marketing, LLC ("DNA") - Privacy
Policy
We
created this website privacy policy ("Privacy Policy") as part of
our commitment to fair information practices and the protection of
the privacy and security of the users ("you" or "your") of our
website (the "Site"). This Privacy Policy will advise you about how
we protect your personal information and what choices you have with
respect to our use of such. We urge you to read this Privacy Policy
carefully.
Application of our Privacy Policy
This Privacy Policy applies to the use of our Site,
products and services owned and operated by us (the "Services").
Note, however, this Privacy Policy does not apply to your use of
unaffiliated sites to which our Site only links. Once you enter
another web site (whether through an advertisement, service, or
content link), be aware that we are not responsible for the privacy
practices of that site. Also, this Privacy Policy only covers
information collected on our Site and does not cover any information
collected by us through other means, such as direct mail, paper
applications, submitted forms, etc.
Types of
Information Collected
Personal Information Collected. In order for you to
access certain premium services and/or to purchase software or other
products that we offer via the Site, we may ask you to provide us
with information that personally identifies you ("Personal
Information"). Personal Information may include data such as:
your name, mailing and/or e-mail addresses ("Contact
Data");
your account or credit card number ("Financial Data");
or
your zip code, age and/or income ("Demographic Data").
If you communicate with us by e-mail, post messages to any of our
chat groups, bulletin boards or forums, or otherwise complete online
forms, surveys or contest entries, any information provided in such
communication may be collected as Personal Information. We will only
collect Personal Information which you voluntarily provide. Your
Personal Information will not be intentionally disclosed to any
unaffiliated third party without your permission. At the time you
place an order or subscribe for premium services you may be given
the option to receive weekly email specials, newsletters, and/or
targeted mailings. You can unsubscribe from receiving email or
similar offers at any time.
Traffic Data Collected. We automatically track and
collect non-personal identification information when you visit our
Site, including your
IP
address (a set of numbers that is assigned to your computer when you
are on the Internet);
domain
server (a computer that stores web site files and provides them to
people who request them);
type
of computer and/or operating system you use;
type
of web browser; and
if
you arrived at the Site via a link from another website, the
referring URL (collectively "Traffic Data"). Traffic Data is
anonymous information that does not personally identify you but is
helpful for marketing purposes or for improving your experience on
the Site. We collect Traffic Data through the use of "Cookie"
technology and "Web Beacons". "Cookies" are data files sent to and
stored on the computer you use to view a web site. "Cookies" can be
used to monitor use of our Site, to customize content specific to
your interests, to ensure that you do not see the same advertisement
repeatedly and to store your user name and password so you do not
have to re-enter it each time you visit the Site. "Web Beacons" are
small graphic image files on a web page which can be utilized by a
web site to determine information about a user. "Web Beacons" are
not used to track information outside of our Site and are not used
to track personal information. The information collected by Web
Beacons allows us to, among other things, statistically monitor the
number of users of our Site, and the websites of our selected
partners.
Uses of Information Collected We
use Contact Data to send you information about our company or our
products or services, or promotional material from some of our
partners, or to contact you when necessary. For example, if you
reside outside the United
States, we may
provide your Contact Data to one of our partners assigned to your
geographic territory. We use your Financial Data to verify your
qualifications for certain products or services and to bill you for
products and services. We use your Demographic Data to customize and
tailor your experience on the Site, displaying content that we think
you might be interested in according to your preferences.
Children We
are committed to protecting the privacy of children. Therefore, we
prohibit registration by children under the age of 13 for all
interactive portions of the Site including forums, chats and message
boards. We will not knowingly collect personally identifiable
information from children under 13. We strongly urge all parents to
participate in their children's exploration of the Internet and any
online services, and to teach their children about protecting their
personal information while online. Furthermore, we may, at our
discretion, require users under 18 to obtain the consent of a parent
or guardian to view certain content, and we may limit access to
certain content to users above a specified age. You agree to abide
by any such restrictions, and not to help anyone avoid these
restrictions.
Sharing of Personal Information
We
may share Personal Information you provide in combination with
Personal Information from other users with advertisers and other
third parties only on an aggregate basis ("Aggregate Data").
Aggregate Data does not contain any information which can be used to
contact or identify you.
User Choice Regarding Collection, Use and Distribution
of Personal Information You
may choose not to provide us with any Personal Information. In such
an event, you can still access and use much of the Site; however you
will not be able to access and use those portions of the Site that
require your Personal Information. If you do not wish to receive
information and promotional material from us or from some of our
partners, you may select the appropriate "opt-out" option each time
we ask you for Personal Information.
Confidentiality and Security of Personal Information
Except as otherwise provided in this Privacy Policy,
we will keep your Personal Information private and will not share it
with third parties, unless such disclosure is necessary to:
comply with a valid legal inquiry or process such as a
search warrant, subpoena, statute or court order;
protect a physical or property threat to you, to
others or to the Site;
respond to a breach or attempted breach of the
security of our Site;
defend or assert our legal rights; or
enforce our Terms of Use. We may also transfer
Personal Information in connection with a corporate merger,
consolidation, the sale of related assets or corporate division or
other fundamental corporate change. In the event we are legally
compelled to disclose your Personal Information to a third party, we
will
attempt to notify you unless doing so would violate the law
or a court order. Your Personal Information is stored on secure
servers that are not accessible by third parties. We provide you
with the capability to transmit your Personal Information via
secured and encrypted channels if you use a similarly equipped web
browser.
User Ability to Access, Update and Correct Personal
Information In
order to ensure that all of your Personal Information is correct and
up-to-date, at any time while logged in you may visit your personal
profile at the Site. Through your personal profile you may:
review and update your Personal Information that we
have already collected;
choose whether or not you wish us to send you
information about our company, or promotional material from some of
our partners; or
choose whether or not you wish us to share some of
your Personal Information with third parties. If you would like to
review any Personal Information we have retained about you in our
database, please send us an e-mail request for this information at
privacyrequest@dnamarketinginc.com. To help us address your request, please specify
which information you wish to review. Once you have reviewed this
information, at your request we will correct Personal Information
about you that you state is incorrect. To request such a correction,
please send an e-mail to privacyrequest@dnamarketinginc.com. Please be aware, however, that it is not always
technologically possible to completely remove or modify information
in our databases and servers although we will always make reasonable
efforts to do so upon your request.
Lost or Stolen Information You
are responsible for maintaining the confidentiality of your Personal
Information including, but not limited to, details of your credit
card(s), user name and password. You shall be responsible for all
uses of your registration, whether or not authorized by you. You
must immediately notify us if your credit card, user name or
password is lost, stolen or used without your permission. In such an
event, we will cancel that credit card number, user name or password
and update our records accordingly.
Other Limits to Your Privacy The
Site contains links to other web sites. We are not responsible for
the privacy practices or the content of such web sites. Once you
link to another web site from our Site, you are subject to the terms
and conditions of that site, including but not limited to that
site's privacy policy and terms of use. We may also make chat rooms,
forums, message boards, and news groups available to you. Although
we strive to protect our users' privacy, we cannot guarantee the
security of the information you post. The information you disclose
in these areas becomes public information. We have no control over
its use and you should exercise caution when deciding to disclose
your Personal Information. You disclose this information at your own
risk.

WITHOUT LIMITATION OF THE FOREGOING, WE SPECIFICALLY DISCLAIM ANY
AND ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO: (I) ANY

RELIABILITY, TIMELINESS OR USEFULNESS OF THE CONTENT OF THE SITE;
AND (II) ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTIES ARISING FROM A

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; OR
(II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER
INACCURACIES IN, OR DESTRUCTIVE PROPERTIES OF THE SITE. IN NO EVENT
SHALL OUR TOTAL LIABILITY TO YOU HEREIN, FOR ANY CLAIM OR ACTION
ARISING FROM USE OF THE WEB SITE (WHETHER IN CONTRACT, TORT OR
OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS
SITE. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE

INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY
SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
